1 Services We Offer
Nzoka AI provides:
- Automated replies to guest messages across social and messaging platforms
- Trip planning assistance and curated local activity suggestions
- Group trip and multi-property automation
- M-Pesa deposit request and payment confirmation messaging
- Integration with Meta Business Manager, WhatsApp Business API, TikTok, and Telegram
- Dashboard access for monitoring conversations, performance, and subscription status
2 User Eligibility
You must be 18 years of age or older and authorised to act on behalf of your business to use Nzoka AI.
3 Account and Platform Access
- For Meta (WhatsApp, Instagram, Facebook): we require access to your Meta Business Manager to connect the WhatsApp Business API and messaging integrations
- For TikTok: we request temporary login access. We strongly recommend changing your password immediately after setup is complete
- For WhatsApp and Telegram: only your business number is required. We handle the full technical setup
- You are responsible for maintaining the security of your accounts and notifying us of any unauthorised access
4 Setup and Payment
- A 10-day free trial is available with no credit card required
- The initial setup fee is equal to your first month's plan cost
- Payment is required after the trial period via M-Pesa, bank transfer, or card through IntaSend
- Plans are billed monthly or yearly depending on your selected billing cycle
- After your contact volume limit is exceeded, an additional fee of KES 800 per 500 extra contacts applies
Launch Offer: Setup is currently free (saves KES 5,000) and your first month is 50% off. This offer is available to businesses that sign up during our launch period.
5 Refund Policy
- Refunds are only available for services that have not yet been rendered
- If your assistant setup has been completed or the service has been accessed, refunds are not possible
- Refund requests must be submitted via our official support channel within 7 days of the incident
- Approved refunds are processed within 14 days
6 Usage Limits and Fair Use
- You must not use Nzoka AI to spam users, send unsolicited bulk messages, or violate Meta, TikTok, or Telegram platform policies
- Automation must be used for legitimate guest communication related to your hospitality business
- Abuse of the automation system or misuse of guest data may result in immediate suspension or termination
- You are responsible for ensuring your assistant replies comply with consumer protection and advertising laws in your jurisdiction
7 Modifications and Termination
- We may update, modify, or discontinue features with or without prior notice
- We reserve the right to suspend or terminate accounts found to be in breach of these Terms or engaging in suspicious, fraudulent, or harmful activity
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period
8 Limitation of Liability
Nzoka AI is not liable for:
- Downtime, policy changes, or API modifications by Meta, TikTok, Telegram, or WhatsApp
- Booking errors caused by incorrect or incomplete property information supplied by you
- Misinterpretation of AI-generated replies by guests
- Revenue loss, missed bookings, or business disruption due to over-reliance on automation
- Guest disputes arising from automated responses that were based on information you provided
9 Kenya Data Protection Act Compliance
Nzoka AI operates in compliance with the Kenya Data Protection Act (2019). As a data processor acting on your behalf:
- We process guest data only as instructed by you and only for the purpose of generating automated replies
- We do not collect, store, or share guest personal data for advertising, profiling, or third-party commercial purposes
- You, as the data controller, are responsible for ensuring your guests are informed that an AI assistant may handle their initial inquiry

10 Governing Law
These Terms are governed by the laws of the Republic of Kenya. All disputes shall be resolved under Kenyan jurisdiction. For EU/EEA users, applicable GDPR provisions also apply.
